ACCESSORY BUILDING
A building, subordinate to and located on the same lot with a main building, the use of which is clearly incidental to that of the main building or to the use of the land, and which is not attached by any part of a common wall or common roof to the main building.

ACCESSORY BUILDING OR USE
A detached building or use incidental or subordinate to the main use of the property and which is located on the same lot as the main use.
ACCESSORY STRUCTURE
The same as APPURTENANT STRUCTURE.
ACCESSORY USE
A use customarily incidental and accessory to the principal use of the land or the building site or to a building or other structure located on the same building site as the accessory use.

AGRICULTURAL STRUCTURE
Any structure used exclusively in connection with the production, harvesting, storage, drying or raising of agricultural commodities.
ALLEY
A public thoroughfare which affords only a secondary means of access of abutting property.
ALLEY
A minor right-of-way dedicated to public use which gives a secondary means of vehicular access to the back side of properties otherwise abutting a street, and which may be used for public utility purposes.
APARTMENT HOUSE
A dwelling used or designed as a residence for three or more families living independently of each other, including apartments, apartment hotels or group housing.
APPEAL
A request for review of the Floodplain Administrator's interpretation of any provision of this chapter or a request for a variance.
APPURTENANT STRUCTURE
A structure that is on the same parcel of property as the principal structure to be insured and the use of which is incidental to the use of the principal structure.
AREA
A specific geographic division of the city.
AREA OF SPECIAL FLOOD HAZARD
The land in the floodplain within a community subject to a 1% or greater chance of flooding in any given year.
AUTOMOBILE SERVICE STATION
Any land, building, structure or premises used for sale at retail of motor vehicle fuels, oils or accessories, or for servicing or lubricating motor vehicles, or installing or repairing parts and accessories.
BASE FLOOD
The flood having a 1% chance of being equaled or exceeded in any given year. BASEMENT. Any area of the structure having its floor subgrade (below ground level) on all sides.
BASEMENT
A story partly or wholly underground. A BASEMENT should be characterized as a story for purpose of height measurement, where more than one-half of its height is above the average level of the adjoining ground.
BILLBOARD
Any structure or part thereof on which is lettered, pictured or displayed matter, the chief purpose of which is for advertising or publicity.
BLOCK
An area of land bounded by streets, railroad rights-of-way, shorelines of streams or other waterways or other lines of demarcation, or a combination thereof.
BLOCK
A parcel of land, intended to be used for urban purposes, which is entirely surrounded by public streets, highways, railroad rights-of-way, public walks, parks or green strips, rural land or drainage channels or a combination thereof.
BOARD OF ALDERMEN
The chief legislative body of the city.
BUILDING
See STRUCTURE.
BUILDING
A structure having one or more stories and a roof, designed primarily for the shelter, support or enclosure of persons, animals or property of any kind.
BUILDING LINE or SETBACK LINE
A line or lines designating the area outside of which buildings may not be erected.
BUILDING, FRONT LINE OF
A line of that base of the building nearest the front line of the lot. This base includes some parlors and covered porches, whether enclosed or unenclosed, but does not include steps.
BUILDING, HEIGHT OF
The vertical distance measured from the average elevation of the proposed finished grade of the building to the highest point of the roof for flat roofs, to the deck line of mansard roofs, and to the mean height between eaves and ridge for gable, hip and gambrel roofs.
BUILDING, PRINCIPAL
A building in which is conducted the main or principal use of the lot on which that building is situated.
CERTIFICATE OF APPROPRIATENESS
A certificate issued by the Historic Preservation Commission (HPC) indicating its approval of plans for alteration, construction, removal or demolition of a landmark or of a structure within an historic district.
CERTIFICATE OF ECONOMIC HARDSHIP
A certificate issued by the HPC authorizing an alteration, construction, removal or demolition, even though a certificate of appropriateness has previously been denied.
CHIEF EXECUTIVE OFFICER or CHIEF ELECTED OFFICIAL
The official of the community who is charged with the authority to implement and administer laws, ordinances and regulations for that community.
CITY
The City of Winfield, Missouri.
CLINIC
An institution, building or part of a building where outpatients receive medical care or treatment.
CLUB
Buildings and facilities owned or operated by a corporation, association, person or persons, for a social, educational or recreational purpose, but not primarily for profit, and not primarily to render a service which is primarily carried on as a business.
COMMERCIAL FEED LOT
An area of land devoted to raising and feeding of livestock where the operation is not a part of normal agricultural activity.
COMMISSION
The City Planning Commission.
COMMUNITY
Any state or area or political subdivision thereof, which has authority to adopt and enforce floodplain management regulations for the areas within its jurisdiction.
CONSTRUCTION
The act of adding an addition to an existing structure or the erection of a new principal or accessory structure on a lot or property.
CONSUMER
The owner or person in control of any premises supplied by or in any manner connected to a public water system.

CULTURAL RESOURCES
Districts, buildings, sites, structures, objects and evidence of some importance to a culture, a subculture, or a community for scientific, engineering, art, tradition, religious or other reasons, significant in providing resource and environmental data necessary for the study and interpretation of past lifeways and for interpreting human behavior.
DAY CARE CENTER
A facility other than the provider's permanent residence, or a facility separate from the provider's living quarters, where care is provided for more than four children for any part of the 24-hour day.
DAY CARE HOME
A family home, occupied as a permanent residence, by the day care provider, in which family-like care is given to more than four children and no more than ten children, not related to the day care provider, for any part of the 24-hour day, for compensation or otherwise, except those operated by a school system or in connection with a business establishment as a convenience for its customers.
DEBRIS
Includes, but is not limited to, dirt, mud, gravel, rocks, concrete, vegetation, lumber, electrical wiring, roofing materials, papers, packaging, building supplies and other items found in or associated with construction, excavation or other project that falls under the scope of the Building Commissioner's jurisdiction.
DEMOLITION
Any act or process which destroys in part or in whole a landmark or a structure within an historic district, or which threatens to destroys a landmark or a structure within an historic district, or which destroys or threatens to destroys a potentially significant property or structure by failure to maintain it in a condition of good repair and maintenance.
DESIGN GUIDE
A standard of appropriate activity that will preserve the historic, prehistoric, architectural, scenic or aesthetic character of a landmark or historic district.
DEVELOPMENT
Any human-made change to improved or unimproved real estate, including, but not limited to, buildings or other structures, levees, levee systems, mining, dredging, filling, grading, paving, excavation or drilling operations or storage of equipment or materials.
DISTRICT
Any section of the city wherein the regulations of this chapter are uniform.
DWELLING
Any building or portion thereof which is designed and used exclusively for residential purposes.
DWELLING UNIT
A room or group of rooms within a dwelling and forming a single, habitable unit with facilities for living, sleeping and cooking.
DWELLING, MULTIPLE
A building or portion thereof used or designed as a residence for three or more families living independently of each other and doing their own cooking therein, including apartments.
DWELLING, SINGLE-FAMILY
A building designed or occupied exclusively by one family.
DWELLING, TWO-FAMILY
A building designed or occupied exclusively by two families living independently of each other and doing their own cooking therein.
EASEMENT
A grant by the property owner to the public, a corporation or persons of the use of a strip of land for specific purposes.
EASEMENT
A grant by the owner of the use of land for a person or persons, or the general public for a specified purpose.
ELEVATED BUILDING
For insurance purposes, a non-basement building which has its lowest elevated floor raised above ground level by foundation walls, shear walls, posts, piers, pilings or columns.
ELIGIBLE COMMUNITY or PARTICIPATING COMMUNITY
A community for which the Administrator has authorized the sale of flood insurance under the National Flood Insurance Program (NFIP).
ENGINEER
A registered professional engineer authorized to practice engineering in the state.
ESSENTIAL SERVICE
The erection, construction, alteration or maintenance by public utilities or municipal departments or commissions, or underground or overhead gas, electrical, steam or water transmission or distribution assistance, collection, communication, supply or disposal systems, including pools, wires, mains, drains, sewers, pipes, conduits, cables, fire alarm boxes, police call boxes, traffic signals, hydrants and other similar equipment and accessories in connection therewith (but not including buildings) reasonably necessary for the furnishing of adequate service by such public utilities or municipal departments or commissions or for the public health or safety or general welfare.
ESTABLISHED GRADE
The elevation of the centerline of the highway in front of the center of the lot, as established by the City Engineer, or other entity.
EXEMPTIONS
(1) Pipes, pipe fittings, plumbing fittings, or fixtures, including backflow preventers, that are used exclusively for non-potable services such as manufacturing, industrial processing, irrigation, outdoor watering, or any other uses where the water is not anticipated to be used for human consumption; or
(2) Toilets, bidets, urinals, fill valves, flush-o-meter valves, tub fillers, shower valves, service saddles, or water distribution main gate valves that are two inches in diameter or larger.
EXISTING CONSTRUCTION
For the purposes of determining rates, structures for which the "start of construction" commenced before the effective date of the FIRM or before 1-1-1975. For FIRMs effective before that date, EXISTING CONSTRUCTION may also be referred to as "existing structures".
EXISTING MANUFACTURED HOME PARK OR SUBDIVISION
A manufactured home park or subdivision for which the construction of facilities for servicing the lots on which the manufactured homes are to be affixed (including, at a minimum, the installation of utilities, the construction of streets and either final site grading or the pouring of concrete pads) is completed before the effective date of the floodplain management regulations adopted by a community.
EXPANSION TO AN EXISTING MANUFACTURED HOME PARK OR SUBDIVISION
The preparation of additional sites by the construction of facilities for servicing the lots on which the manufactured homes are to be affixed (including the installation of utilities, the construction of streets and either final site grading or the pouring of concrete pads).
FAMILY
One or more persons related by blood or marriage, including adopted children, or a group of not-to-exceed five persons (excluding servants) not all related by blood or marriage, occupying premises and living as a single, non-profit housekeeping unit, as distinguished from a group occupying a boarding or lodging house, hotel, club or similar dwellings of group use. A FAMILY should be deemed to include domestic servants employed by the family.
FLOOD BOUNDARY AND FLOODWAY MAP (FBFM)
An official map of a community on which the Administrator has delineated both special flood hazard areas and the designated regulatory floodway.
FLOOD ELEVATION DETERMINATION
A determination by the Administrator of the water surface elevations of the base flood. That is, the flood level that has a 1% or greater chance of occurrence in any given year.
FLOOD ELEVATION STUDY
An examination, evaluation and determination of flood hazards.
FLOOD FRINGE
The area outside the floodway encroachment lanes, but still subject to inundation by the regulatory flood.
FLOOD HAZARD BOUNDARY MAP (FHBM)
An official map of a community, issued by the Administrator, where the boundaries of the flood areas having special flood hazards have been designated as (unnumbered or numbered) A Zones.
FLOOD INSURANCE RATE MAP (FSRM)
An official map of a community, on which the Administrator has delineated both the special flood hazard areas and the risk premium zones applicable to the community.
FLOOD INSURANCE STUDY (FIS)
An examination, evaluation and determination of flood hazards and, if appropriate, corresponding water surface elevations.
FLOOD or FLOODING
A general and temporary condition of partial or complete inundation of normally dry land areas from: (1) The overflow of inland; and/or (2) The unusual and rapid accumulation or runoff of surface waters from any source.
FLOODPLAIN MANAGEMENT
The operation of an overall program of corrective and preventive measures for reducing flood damage, including, but not limited to, emergency preparedness plans, flood control works and floodplain management regulations.
FLOODPLAIN MANAGEMENT REGULATIONS
Zoning ordinances, subdivision regulations, building codes, health regulations, special purpose ordinances (such as floodplain and grading ordinances) and other applications of police power. The term describes such state or local regulations, in any combination thereof, that provide standards for the purpose of flood damage prevention and reduction.
FLOODPLAIN or FLOOD-PRONE AREA
Any land area susceptible to being inundated by water from any source. (See FLOODING.)
FLOOD-PROOFING
Any combination of structural and non-structural additions, changes or adjustments to structures that reduce or eliminate flood damage to real estate or improved real property, water and sanitary facilities or structures and their contents.
FLOODWAY ENCROACHMENT LINES
The lines marking the limits of floodways on federal, state and local floodplain maps.
FLOODWAY or REGULATORY FLOODWAY
The channel of a river or other watercourse and the adjacent land areas that must be reserved in order to discharge the base flood without cumulatively increasing the water surface elevation more than one foot.
FREEBOARD
A factor of safety usually expressed in feet above a flood level for purposes of floodplain management. FREEBOARD tends to compensate for the many unknown factors that could contribute to flood heights greater than the height calculated for a selected size flood and floodway conditions, such as bridge openings and the hydrological effect of urbanization of the watershed.
FUNCTIONALLY DEPENDENT USE
A use that cannot perform its intended purpose unless it is located or carried out in close proximity to water. This term includes only docking facilities and facilities that are necessary for the loading and unloading of cargo or passengers, but does not include long-term storage or related manufacturing facilities.
GARAGE, PRIVATE
A building used only for the housing of motor vehicles without their equipage for operation, repair, hire or sale.
GENERAL PLAN
The comprehensive development plan for the city which has been officially adopted to provide long range development policies for the area subject to urbanization in the foreseeable future and which includes, among other things, the plan for land use, land subdivision, circulation and community facilities.
HIGHEST ADJACENT GRADE
The highest natural elevation of the ground surface prior to construction next to the proposed walls of a structure.
HISTORIC DISTRICT
An area designated as an historic district by ordinance of the Board of Aldermen which may include individual landmarks, as well as other properties or structures which, while not of such historic and/or architectural significance to be designated as landmarks, nevertheless contribute to the overall visual characteristics and historical significance of the historic district.
HISTORIC SIGNIFICANCE
Character, interest or value as part of the development, heritage, or culture of the community, county, state or country; as the location of an important local, county, state or national event; or through identification with a person or persons who made an important contribution to the development of the community, county, state or country.
HISTORIC STRUCTURE
Any structure that is:
(1) Listed individually in the National Register of Historic Places (a listing maintained by the Department of Interior) or preliminarily determined by the Secretary of the Interior as meeting the requirements for individual listing on the National Register;
(2) Certified or preliminarily determined by the Secretary of the Interior as contributing to the historical significance of a registered historic district or a district preliminarily determined by the Secretary to qualify as a registered historic district;
(3) Individually listed on a state inventory of historic places in states with historic preservation programs which have been approved by the Secretary of the Interior; or
(4) Individually listed on a local inventory of historic places in communities with historic preservation programs that have been certified either:
(a) By an approved state program as determined by the Secretary of the Interior; or
(b) Directly by the Secretary of the Interior in states without approved programs.
HOME OCCUPATION
An occupation for gain or support conducted only by members of a family residing on the premises; provided that, no articles are sold or offered for sale except such as may be produced by members of the immediate family residing on the premises.
HOSPITAL
An institution for the medical or surgical care of the sick and injured on a confined basis.
HOTEL
Any building or portion thereof of which contains guest rooms, which are designed or intended to be used, let or hired out for occupancy by, or which are occupied by ten or more individuals for compensation, whether it be paid directly or indirectly.
HPC
Members of the Historic Preservation Commission.
JUNKYARD
A lot, land or structure, or part thereof, used primarily for the collecting, storage and sale of wastepaper, rags, scrap metal or discarded material, or for the collection, dismantling, storage and salvaging of machinery or vehicles not in running condition, and for sale of parts thereof.
LANDMARK
A property or structure designated as a landmark by ordinance of the Board of Aldermen, pursuant to procedures prescribed herein, which is worthy of rehabilitation, restoration, interpretation and preservation because of its historic, architectural or archaeological significance to the city.
LEAD BASE MATERIALS
Any material containing lead in excess of the quantities specified in the definition of LEAD FREE.
LEAD FREE
(1) In general.
​​(a) When used with respect to solder and flux, refers to solders and flux containing not more than .2% lead; and
(b) When used with respect to pipes and pipe fittings, refers to pipes and pipe fittings containing not more than .25% lead.
(2) Calculation. The weighted average lead content of a pipe, pipe fitting, plumbing fitting, or fixture shall be calculated by using the following formula: For each wetted component, the percentage of lead in the component shall be multiplied by the ratio of the wetted surface area of that component to the total wetted surface area of the entire product to arrive at the weighted percentage of lead of the component. The weighted percentage of lead of each wetted component shall be added together, and the sum of these weighted percentages shall constitute the weighted average lead content of the product. The lead content of the material used to produce wetted components shall be used to determine compliance with the division (a)2. above. For lead content of materials that are provided as a range, the maximum content of the range shall be used.
LOADING SPACE
An off-street space or berth on the same lot as a building, or contiguous to a group of buildings, for the temporary parking of a commercial vehicle while loading or unloading merchandise or materials, and which abuts upon a street or other appropriate means of access.
LOT
A platted parcel of land to be separately owned, developed or otherwise used as a unit.
LOT
A subdivision of a block or other parcel intended as a unit for the transfer of ownership or for development.
LOT OF RECORD
A lot or parcel of land, the deed to which has been recorded in the office of the County Clerk and/or the county's Recorder of Deeds prior to the adopting of these regulations.
LOT, CORNER
A lot located at the intersection of and abutting on two or more streets.
LOT, DOUBLE FRONTAGE
A lot which runs through a block from street to street and which has two non-intersecting sides abutting on two or more streets.
LOWEST FLOOR
The lowest floor of the lowest enclosed area, including basement. An unfinished or flood-resistant enclosure, usable solely for parking of vehicles, building access or storage, in an area other than a basement area, is not considered a building's LOWEST FLOOR; provided that, such enclosure is not built so as to render the structure in violation of the applicable flood-proofing design requirements of this chapter.
MANUFACTURED HOME
A structure, transportable in one or more sections, that is built on a permanent chassis and is designed for use with or without a permanent foundation when attached to the required utilities. The term MANUFACTURED HOME does not include a "recreational vehicle".
MANUFACTURED HOME PARK OR SUBDIVISION
A parcel (or contiguous parcels) of land divided into two or more manufactured home lots for rent or sale.
MANUFACTURING
Fabrication from raw materials into a product suitable for use by hand or machinery.
MAP
The Flood Hazard Boundary Map (FHBM), Flood Insurance Rate Map (FIRM) or the Flood Boundary and Floodway Map (FBFM) for a community issued by the Federal Emergency Management Agency (FEMA).
MARIJUANA or MARIHUANA
Cannabis indica, Cannabis sativa, and Cannabis ruderalis, hybrids of such species, and any other strains commonly understood within the scientific community to constitute marijuana, as well as resin extracted from the plant and marijuana-infused products. "Marijuana" or "Marihuana" do not include industrial hemp containing a crop-wide average tetrahydrocannabinol concentration that does not exceed three-tenths of one percent (0.3%) on a dry weight basis, or commodities or products manufactured from industrial hemp.
MARIJUANA-INFUSED PRODUCTS
Products that are infused with marijuana or an extract thereof and are intended for use or consumption other than by smoking, including, but not limited to, edible products, ointments, tinctures and concentrates.
MARKET VALUE or FAIR MARKET VALUE
An estimate of what is fair, economic, just and equitable value under normal local market conditions.
MEAN SEA LEVEL
For purposes of the National Flood Insurance Program (NFIP), the National Geodetic Vertical Datum (NGVD) of 1929 or other datum, to which base flood elevations shown on a community's Flood I.
MEDICAL MARIJUANA FACILITY
Any of the following:
MINIMUM MAINTENANCE
The minimum regulations governing the conditions and maintenance of all existing structures, as set out in the BOCA Basic National Existing Structures Code, First Edition (1984), as published by the BOCA Building Officials and Code Administrators International, Inc., and adopted by reference, with certain amendments thereto by the Board of Aldermen of the city, as such existing structures code shall be amended from time to time by the city.
MOBILE HOME
A structure, transportable in one or more sections, which is built on a permanent chassis and which is designed for use with or without a permanent foundation when connected to the required utilities.
MOBILE HOME
A one-family dwelling unit of vehicular portable design built on a chassis and designed to be moved from one site to another and to be used without a permanent foundation.
MOBILE HOME COURT or TRAILER PARK
Any lot or parcel used for two or more mobile homes, trailers or camp cars, or other portable or mobile shelters used for living purposes.
NEW CONSTRUCTION
For the purposes of determining insurance rates, structures for which the "start of construction" commenced on or after the effective date of an initial FIRM or after 12-31-1974, whichever is later, and includes any subsequent improvements to such structures. For floodplain management purposes, NEW CONSTRUCTION means structures for which the "start of construction" commenced on or after the effective date of the floodplain management regulations adopted by a community and includes any subsequent improvements to such structures.
NEW MANUFACTURED HOME PARK OR SUBDIVISION
A manufactured home park or subdivision for which the construction of facilities for servicing the lot on which the manufactured homes are to be affixed (including at a minimum, the installation of utilities, the construction of streets and either final site grading or the pouring of concrete pads) is completed on or after the effective date of floodplain management regulations adopted by the community.
NFIP
The National Flood Insurance Program (NFIP).
NON-CONFORMING USE
Any building or land lawfully occupied and being used at the time of passage of these regulations in a manner which does not conform with the use regulations of the district within which it is located.
NURSERY SCHOOL
A school operated by a person or organization which is conducted primarily for education of preschool-age children, for no more than four hours per child per day and which provides no custodial care.
NURSING HOME
A home for the aged or infirm in which three or more persons not of the immediate family are received, kept or provided with food and shelter, or care for compensation; but not including hospitals, clinics or similar institutions devoted primarily to the diagnosis and treatment of the sick or injured.
ORDINARY MAINTENANCE
Any work for which a building permit is not required by municipal ordinance, where the purpose and effect of such work is to correct any deterioration or decay of, or damage to, a structure or any part thereof and to restore the same, as nearly as may be practical, to its condition prior to the occurrence of such deterioration, decay or damage, and does not involve change of materials nor of form.
OWNER OF A FENCE
Any person, persons or their successors who purchase or otherwise acquire the property from the person who originally erected or caused a fence to be erected thereon.
OWNER OF RECORD
The person, corporation or other legal entity listed as owner on the records of the County Recorder of Deeds.
PARKING SPACE
A surfaced area, enclosed or unenclosed, sufficient in size to store one automobile (not less than ten feet wide and 20 feet long) connected to a public street or alley by a surface driveway and permanently reserved for the parking or storage of one motor vehicle.
PARTICIPATING COMMUNITY
Also known as an ELIGIBLE COMMUNITY. A community in which the Administrator has authorized the sale of flood insurance.
PERMITTED USE
A use which may be lawfully established in a particular district or districts; provided, it conforms with all the requirements, regulations and performance standards of the district.
PERSON
Individual, state, county, other political subdivisions, firm, association, organization, partnership, trust, company or corporation.
PERSON
Includes any individual or group of individuals, corporation, partnership, association or any other entity, including federal, state and local governments and agencies.
PLAT
A map, plan or layout of a city, township, section or subdivision indicating the scale, location and boundaries of individual properties.
PLAT, FINAL
A map of a land subdivision prepared in a form suitable for filing of record with necessary affidavits, dedications and acceptances, and with complete bearings and dimensions of all lines defining lots and blocks, streets and alleys, public areas and other dimensions of land.
PLAT, PRELIMINARY
A map of a proposed land subdivision showing the character and proposed layout of the tract in sufficient detail to indicate the suitability of the proposed subdivision of land.
PORTABLE STRUCTURE
Any structure originally designed to be moved from place to place by wheels, skids, or otherwise; not attached to a permanent structure or main building, and is of a temporary nature.
PRINCIPALLY ABOVE GROUND
At least 51% of the actual cash value of the structure, less land value, is above ground.
PRIVATE POOL
A swimming pool that is located on the property of a single-family residence.
PUBLIC DRINKING WATER SYSTEM
Any publicly or privately owned water system supplying water to the general public which is satisfactory for drinking, culinary and domestic purposes and meets the requirements of the Missouri Department of Natural Resources.
PUBLIC IMPROVEMENT PROJECT
An action by the city, or any of its departments or agencies involving major modification or replacement of streets, sidewalks, curbs, streetlights, street or sidewalk furniture, landscaping, parking, or other portions of the public infrastructure servicing commercial, residential, recreational or industrial development; or any undertakings affecting city parks or city-owned structures.
PUBLIC POOL
A swimming pool that is operated by any public agency or private agency or person offering access to the general public.
PUBLIC UTILITY
Any person duly authorized to furnish, and furnishing, under municipal regulation to the public, electricity, gas, steam, telephone, telegraph, transportation, water, sewerage or sewage disposal.
RECREATIONAL VEHICLE
A motor vehicle or trailer that includes living quarters designed for accommodation.
REMEDY A VIOLATION
To bring the structure or other development into compliance with federal, state or local floodplain management regulations; or, if this is not possible, to reduce the impacts of its non-compliance.
REMOVAL
Any relocation of a structure, object or artifact on its site or to another site.
REPAIR
Any change that is not construction, alteration, demolition or removal and is necessary or useful for continuing normal maintenance and upkeep.
REPETITIVE LOSS
Flood-related damages sustained by a structure on two separate occasions during a ten-year period for which the cost of repairs at the time of each such flood event, equals or exceeds 25% of the market value of the structure before the damage occurred.
RESPONSIBLE PARTY
The person, agent, corporation, partnership or other legal entity who placed the amount required under this subchapter in escrow.
RISK PREMIUM RATES
Those rates established by the Administrator pursuant to individual community studies and investigations which are undertaken to provide flood insurance in accordance with § 1307 of the National Flood Disaster Protection Act of 1973, being 42 U.S.C. § 4014, and the accepted actuarial principles. RISK PREMIUM RATES include provisions for operating costs and allowances.
ROADWAY
All public roads, streets, highways and other throughways upon which the city, county or state provides service in the form of building, repair or maintenance. The term ROADWAY also includes all traffic lanes, turning lanes, shoulders, gutters, curbs and areas within the easement granted for the building of the roadway, as well as all public sidewalks within ten feet of the roadway.
SECRETARY OF THE INTERIOR'S STANDARDS
The Secretary of the Interior's Standards for the Treatment of Historic Properties are sets of treatment standards intended to assist users in making sound historic preservation decisions for the preservation, rehabilitation, restoration or reconstruction of historic properties. The standards are codified as 36 C.F.R. Part 68 in the 7-12-1995, Federal Register (Vol. 60, No. 133).
SEMI-PRIVATE POOL
A swimming pool that is located in conjunction with a multi-family development, apartment complex, motel or hotel, or is operated for or by a homeowner's association.
SIGN
Any words, numerals, figures, devices and/or designs with trademarks by which anything is made known, such as a use to designate an individual, a firm, profession, business or a commodity which are visible from any public street or air.
SITE
The traditional, documented or legendary location of an event, occurrence, action or structure significant in the life or lives of a person, persons, groups, or tribe, or any place with evidence of past human activity. SITES include, but are not limited to, cemeteries, burial grounds, occupation and work areas, evidence of farming or hunting and gathering, battlefields, settlements, estates, gardens, groves, river crossings, routes and trails, caves, quarries, mines or significant trees or other plant life.
SPECIAL FLOOD HAZARD AREA
See AREA OF SPECIAL FLOOD HAZARD.
SPECIAL HAZARD AREA
An area having special flood hazards and shown on an FHBM, FIRM or FBFM as Zones (unnumbered or numbered) A and AE.
SPECIAL USE
A use allowed in a zoning district after a permit is granted by the Planning and Zoning Commission.
START OF CONSTRUCTION
Includes substantial-improvements, and means the date the building permit was issued; provided, the actual START of construction, repair, reconstruction, rehabilitation, addition placement or other improvements were within 180 days of the permit date. The actual START means either the first placement of permanent construction of a structure on a site, such as the pouring of slabs or footings, the installation of piles, the construction of columns, any work beyond the stage of excavation or the placement of a manufactured home on a foundation. Permanent construction does not include land preparation, such as clearing, grading and filling, the installation of streets and/or walkways, excavation for a basement, footings, piers, foundations, the erection of temporary forms, nor installation on the property of accessory structures, such as garages or sheds not occupied as dwelling units or not part of the main structure. For a substantial improvement, the actual START OF CONSTRUCTION means the first alteration of any wall, ceiling, floor or other structural part of a building, whether or not that alteration affects the external dimensions of the building.
STATE COORDINATING AGENCY
The agency of the state government, or other office designated by the Governor of the state or by state statute at the request of the Administrator to assist in the implementation of the National Flood Insurance Program (NFIP) in the state.
STOP WORK ORDER
An order directing an owner, occupant, contractor or subcontractor to halt an action for which a certificate of appropriateness is required, and notifying the owner, occupant, contractor or subcontractor of the application process for a certificate of appropriateness.
STORY
The portion of a building included between the surface of any floor and the surface of the next floor above it, or if there is no floor above it, then the space between such floor and ceiling next above it.
STREET
Any public or private right-of-way which affords the primary means of access to abutting property.

STREET, COLLECTOR
A minor street which collects traffic from other minor streets and serves as the most direct route to a major street or a community facility.
STREET, CUL-DE-SAC
A minor street having one end open to vehicular traffic and having one closed end terminated by a turnaround.
STREET, FRONTAGE OR SERVICE
A minor street auxiliary to and located on the side of a major street for service to abutting properties and adjacent areas and for control of access.
STREET, MAJOR
An arterial street which is designated on the major street plan or comprehensive plan.
STREET, MINOR
Any street not classified as a major street on the major street plan or comprehensive plan.
STRUCTURAL ALTERATION
Any change, except those required by law or ordinance, which would prolong the life of the supporting members of the building or structure, such as bearing walls, columns, beams or girders, not including openings in bearing walls as permitted by other ordinances.
STRUCTURE
Anything constructed or erected.
STRUCTURE
For floodplain management purposes, a walled and roofed building, including a gas or liquid storage tank, that is principally above ground, as well as a manufactured home. STRUCTURE for insurance purposes, means a walled and roofed building, other than a gas or liquid storage tank, that is principally above ground and affixed to a permanent site, as well as a manufactured home on a permanent foundation. For the latter purpose, the term includes a building while in the course of construction, alteration or repair, but does not include building materials or supplies intended for use in such construction, alteration or repair, unless such materials or supplies are within an enclosed building on the premises.
STRUCTURE
Anything constructed or erected, the use of which requires permanent or temporary location on or in the ground, including, but without limiting the generality of the foregoing, buildings, fences, gazebos, advertising signs, billboards, backstops for tennis courts, radio and television antennae and towers, and swimming pools.
SUBDIVIDER
Any person, firm, partnership, corporation or other entity, acting as a unit, subdividing or proposing to subdivide land.
SUBDIVISION
The division or re-division of land onto two or more lots, tracts, sites or parcels for the purpose of transfer of ownership or for development, or the dedication or vacation of a public or private right-of-way or easement.
SUBDIVISION
The division of a parcel of land into two or more lots, or other divisions of land; it includes resubdivision and, when appropriate to the context, relates to the process of subdividing or to the land or territory subdivided.
SUBSTANTIAL DAMAGE
(1) Damage of any origin sustained by a structure whereby the cost of restoring the structure to its before damaged condition would equal or exceed 50% of the market value of the structure before the damage occurred. The term includes "repetitive loss buildings" (see definition). For the purposes of this definition, "repair" is considered to occur when the first repair or reconstruction of any wall, ceiling, floor or other structural part of the building commences.
(2) The term does not apply to:
(a) Any project for improvement of a building required to comply with existing health, sanitary or safety code specifications which have been identified by the Code Enforcement Official and which are solely necessary to assure safe living conditions;
(b) Any alteration of a "historic structure"; provided that, the alteration will not preclude the structure's continued designation as a "historic structure"; or
(c) Any improvement to a building.
SUBSTANTIAL IMPROVEMENT
(1) Any combination of reconstruction, alteration, or improvement to a building, taking place during the life of the building, in which the cumulative percentage of improvement equals or exceeds 50% of the current market value of the building. For the purposes of this definition, an improvement occurs when the first alteration of any wall, ceiling, floor or other structural part of the building commences, whether or not that alteration affects the external dimensions of the building. This term includes structures, which have incurred "repetitive loss" or "substantial damage", regardless of the actual repair work done.
(2) The term does not apply to:
(a) Any project for improvement of a building required to comply with existing health, sanitary or safety code specifications which have been identified by the Code Enforcement Official and which are solely necessary to assure safe living conditions;
(b) Any alteration of a "historic structure"; provided that, the alteration will not preclude the structure's continued designation as a "historic structure"; or
(c) Any building that has been damaged from any source or is categorized as repetitive loss.
(3) **Recommend development of written and adopted policy and procedure.
SUBSTANTIALLY IMPROVED EXISTING MANUFACTURED HOME PARKS OR SUBDIVISIONS
Where the repair, reconstruction, rehabilitation or improvement of the streets, utilities and pads equals or exceeds 50% of the value of the streets, utilities and pads before the repair, reconstruction or improvement commenced.
SURVEY
The systematic gathering of information on the architectural, historic, scenic, and archaeological significance of buildings, sites, structures, areas, or landscapes, through visual assessment in the field and historical research for the purpose of identifying landmarks or districts worthy of preservation.
SWIMMING POOL
A receptacle for water or an artificial pool of water having depth at any point of more than two feet intended for the purpose of immersion or partial immersion therein of human beings and including all accessory equipment.
TRAILER
A vehicle designed for carrying persons or property on its own structure and for being drawn by another motor vehicle, including, but not limited to, box trailers, utility trailers, and flatbed trailers.
TRAVEL TRAILER
A vehicular, portable structure built on a chassis and designed to be used for temporary occupancy for travel, recreational or vacational use; with the manufacturer's permanent identification TRAVEL TRAILER thereon; and when factory equipped for the road, being of any length provided its gross weight does not exceed 4,500 pounds, or being of any weight; provided, its overall length does not exceed 28 feet.
USE
The purpose for which land or a building is arranged, designed or intended, or for which either land or a building is, or may be occupied or maintained.
VARIANCE
A grant of relief by the community from the terms of a floodplain management regulation. Flood insurance requirements remain in place for any varied use or structure and cannot be varied by the community.
VIOLATION
The failure of a structure or other development to be fully compliant with the community's floodplain management regulations. A structure or other development without the elevation certificate, other certifications or other evidence of compliance required by this chapter is presumed to be in VIOLATION until such time as that documentation is provided.
WATER PURVEYOR
The owner, operator, or individual in responsible charge of a public water system.
WATER SURFACE ELEVATION
The height in relation to the National Geodetic Vertical Datum (NGVD) of 1929 (or other datum where specified) of floods of various magnitudes and frequencies.
YARD
An open space other than a court on the same lot with a building or a group of buildings, in which the open space lies between the building or group of buildings and the nearest lot line, and is unoccupied and unobstructed from the ground upward.
YARD, FRONT
A space extending across the width of the lot, the depth of which is the minimum horizontal distance between the front lot line and a main building line parallel thereto on the lot.
YARD, REAR
A space extending across the width of the lot, and situated between rear lot lines and the rear line of the main building projected to side lines of lot.
YARD, SIDE
A yard between the main building and the side lot line and extending from the front lot line to the rear lot line.

For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning. The word BUILDING should include the word STRUCTURE and PREMISES; words INTENDED, DESIGNED or ARRANGED TO BE OCCUPIED; the word LOT includes the words PLOT or PARCEL, and the word PERSON includes a firm, association, organization, partnership, trust, company, corporation, as well as an individual.
